Reference translation.
These terms set out the conditions under which members use B.A.D. GYM URAWA, operated by ROCKEDGE Property Management Inc. Individual rules published by the gym form part of these terms.
A member is a person who has agreed to these terms, applied in the form the gym specifies, and been accepted.
Membership begins when the gym accepts the application and the joining fee and first month’s fee are paid. The joining fee is charged once and is not refunded, except where membership fails to start through the gym’s fault. A person who rejoins after leaving pays the joining fee again.
If your registered details change — name, address, email, telephone, emergency contact — please update them promptly from My Page. Where a failure to do so causes you a loss, the gym is not responsible except in cases of its own intent or gross negligence.
Membership is open from the age of 18. People aged 16 or 17 may join with the written consent of a parent or guardian (including by electronic means). People under 16 may not join.
The gym may refuse an application from a person who has previously been expelled, who has made a false statement in an application, or who falls under Article 20 (exclusion of organised crime).
The monthly fee for the following month is collected from the registered card on the 27th of each month. The first payment is made when the application is completed. Fees are not refunded for a month already started.
If fees are revised, the gym will give notice at least one month before the change takes effect, both on the website and by email to the registered address. A member who does not accept the new fee may leave before the effective date.
A member may suspend membership in units of one month, for up to three consecutive months. Apply from My Page by 23:59 on the last day of the month before the month you wish to suspend. Membership resumes automatically when the suspension period ends, and collection of the following month’s fee restarts.
To leave, apply from My Page by 23:59 on the 10th of the month in which you wish to leave. An application after that date takes effect at the end of the following month. You may use the gym until the last day of the month in which you leave; fees are not pro-rated.
The gym may suspend use of the facility or expel a member who breaches these terms or any individual rule, who fails to pay fees by the due date, or who falls under Article 4(2).
The facility may be used only by the member in person. Lending or transferring your My Page screen or any other proof of membership to a third party is prohibited.
At busy times, please do not occupy one piece of equipment for a long period. Staff may ask members to share.
Lockers are for same-day use. A locker left locked at closing time may be opened by the gym; its contents are held for one month and may then be disposed of.
Valuables are not held for members. Please do not bring cash, jewellery or other valuables into the facility.
Conduct that endangers others, nuisance behaviour, commercial activity without permission, unauthorised coaching for a fee, and bringing in prohibited items are not permitted.
Staff do not spot. Set the safety racks to a height suited to your body before every set.
Loose (powdered) chalk may not be used or brought in. Liquid chalk is provided in the gym free of charge.
Please tell the gym about any condition that affects training. Train within your own limits and stop if you feel unwell.
In an emergency the gym will take the steps it judges necessary, including calling for an ambulance and contacting your registered emergency contact.
When taking photographs or video in the facility, take care not to capture other members. Please follow any instruction from staff.
The gym may close temporarily or change its opening hours for maintenance, disaster, infection control or other necessary reasons, with notice on the website and by email where time allows.
Personal information is handled in accordance with the privacy policy published by the gym.
The gym is responsible for damage caused by its own intent or negligence, to the extent provided by law. Clauses that exclude all liability are void under the Consumer Contract Act, and the gym does not use them.
A member who damages the facility or equipment, or causes loss to the gym or to another member, is responsible for that loss.
A member represents that they are not a member of, or connected to, an organised crime group. The gym may terminate membership immediately if this proves untrue.
If these terms are changed, the gym will publish the new text and its effective date on the website before it takes effect, and will also notify members by email. Fee revisions follow Article 6.
The gym contacts members by email to the registered address, by notice on My Page, or by notice on the website.
Members contact the gym through the website enquiry form or by email to [email protected]. The gym does not take enquiries or process procedures by telephone.
Where a message fails to arrive because a registered email address is wrong or was not updated, it is treated as having arrived when it would normally have done so.
If any provision is held invalid, the remaining provisions stay in force.
These terms are governed by Japanese law. The Saitama District Court has exclusive jurisdiction in the first instance.
